Booth LLP Wins Defense Verdict in Discrimination-Retaliation Case
After nearly two weeks of a hard fought trial in an employment case where the plaintiff sought $2.5 million, a Riverside, CA jury delivered a complete defense verdict for Swift Transportation. Hillary Booth was the lead trial attorney, assisted by Associate Madison Romine. During the trial, Booth established that Plaintiff's employment was terminated because of his unsafe driving and not, as he had claimed, in retaliation for taking FMLA leave. During the trial, the Court granted Swift's Motion for Nonsuit on Plaintiff's claim for punitive damages, finding that Plaintiff failed to establish the requisite elements for such damages.
