Booth LLP Wins Nonsuit in a Wrongful Termination-Discrimination Case

After Plaintiff presented his evidence to the jury, Hillary Booth presented and argued a Motion for Nonsuit, challenging each cause of action asserted by Plaintiff, demonstrating that he had failed to present evidence sufficient to prevail as a matter of law. The arguments were based both on the lack of evidence, and the admissions made by Plaintiff during cross-examination showing that the termination of his employment by Swift Transportation was proper, and not resulting from discrimination or any other wrongful act or motive. The Court granted the motion in full, ending the case with a defense win.
