Hillary Booth Presents a Panel Discussion on Techniques to Reduce the Chances of a Nuclear Verdict

Hillary Booth moderated a panel discussion titled, “It’s a Damages Case, Now What?” The panel was presented at the Transportation Law Institute, in Salt Lake City, in October 2023.
The panel focused on non-economic damages in personal injury and death cases. The discussion included techniques for defending claims for pre-death pain and suffering, pre-impact terror, emotional distress, beneficiary claims, and loss of consortium. The panel discussed plaintiffs’ techniques like “anchoring” that are used to inflate damage awards and provided education to the attendees on valuable strategies and techniques that can be used to diffuse those efforts.
