Mr. Levine has extensive experience successfully representing clients in all stages of the litigation process, including jury and court trials, arbitrations, mediations, and appeals.Mr. Levine has represented businesses in a wide variety of complex cases, including claims involving breach of contract, construction, unfair competition, environmental contamination, and business torts. Over his career, he has represented manufacturing companies in contract, toxic tort, CERCLA, and unfair competition claims; service companies in trade secret, employment, professional malpractice, and Cartwright Act claims; technology companies in business interference and contractual claims; real estate brokerages in commission disputes and negligence claims; property owners in environmental claims and CEQA disputes; consulting companies in misrepresentation and unfair competition claims; "start-up" companies in licensing issues and partnership disputes; and import/export companies in breach of contract and product liability claims.
Mr. Levine specializes in the use of motion practice to narrow litigation issues before trial. For instance, Mr. Levine has successfully prepared and argued motions for summary judgment and adjudication resulting in the dismissal of numerous complaints and claims, including a class action complaint alleging improper escheatment practices against an aerospace client, an interference with contract complaint against an information technology client, a multi-million dollar stock option claim against a manufacturer client, and a loss of profits claim against an environmental consultant client. Mr. Levine also has significant experience in successfully preparing and arguing motions brought under California anti-SLAPP statutes.
Mr. Levine has substantial experience in representing clients in jury and court trials. In 2006, Mr. Levine was part of the trial team that obtained a $24.2 million jury verdict for their client in a complex healthcare contractual dispute -- the seventh largest jury verdict in California in that year. More recently, he obtained a $3.6 million CERCLA award after a hotly contested court trial in United States District Court. Additionally, Mr. Levine has significant experience arguing appeals in front of state and federal appellate courts.
Mr. Levine has authored and/or co-authored articles on various legal topics, including "Restricting the Reach of RCRA" which appeared in the ABA Superfund Litigation Newsletter (December 2011). In addition to being an active member of the State Bar of California, he is also licensed to practice in Arizona.
